As used in this Privacy Policy, “Company,” “we,” “our,” and “us” refers to Trumark Companies, together with its affiliates, subsidiaries, divisions and brands.

Your privacy is very important to us. Accordingly, we have prepared this Privacy Policy to explain how we collect, use, protect, and disclose information and data when you use any Company website displaying or linking to this Privacy Policy (“Sites”) and services offered by us, such as when you:

Collectively, these services offered by us are referred to as the “Services.”

This Privacy Policy does not apply to: 

(i)Third party services, websites, applications, digital media (embedded or direct links), or other third-party materials or content that we may link to that are not operated by us ( “Linked Sites”). Linked Sites have their own personal information collection and use practices, for which we have no control over and are not responsible for. We encourage you to read each Linked Site’s privacy disclosures to understand how your personal information is processed when using those Linked Sites.

(ii)Personal information of job applicants and current or former employees. 

(iii)The processing of non-personal information that cannot be linked to an identifiable or identified individual, including, for example, non-identifying aggregate information. We may process this data for any legitimate business purpose.

We may update this Privacy Policy from time to time. We encourage you to review the Privacy Policy whenever you access our Site and use our Services or otherwise interact with us to stay informed about our current practices and the choices available to you.

We are committed to conducting our business in accordance with these principles and to implementing reasonable measures to protect the confidentiality of Personal Information:

1.     MANAGING YOUR INFORMATION PREFERENCES
Consumer Privacy Requests and Communication
You can review, correct, update, or change your Personal Information (as defined in Section 2) or opt out of receiving certain communications from us by e-mailing us at privacy@trumarkhomes.com. Note that you cannot opt out of receiving all communications from us, such as certain communications that include informational updates. From time to time, we may sell your Personal Information that we collect from you to third parties, provided that we first obtain your written consent.  You can always revoke that consent by emailing us at privacy@trumarkhomes.com to request that your Personal Information not be sold in the future.

Global Privacy Controls
To utilize Global Privacy Controls (“GPC”) to manage your privacy preferences, including opting out of the sale or sharing of your Personal Information, you will first need to enable this feature in your web browser or through certain privacy-focused browser extensions. 2.     INFORMATION WE COLLECT
We collect certain personal information from you for the purposes of providing our Services, improve our customer offerings, creating and improving internal operations and business practices.  Such personal information may include information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with you or your household (“Personal Information”). 
The means for collection of such Personal Information may be directly from you, through your interactions with our Sites or Services, as well as through automatic collection means (such as information that is automatically sent from your device when navigating to our Sites) and such information may be combined with other information that we collect about you.  Please note that we do utilize third parties to assist with such collection, wherein your Personal Information is provided to third party service providers for processing on our behalf to provide the functionality of the Sites and Services that we provide you.
Personal Information that we collect falls generally within the following categories.

Personal Identifiers
We collect information that personally identifies you, such as your name, address, phone number, mobile phone number, e-mail, and other personally identifiable information that you provide to us (“Personal Identifiers”). You may be asked to provide us with Personal Identifiers when you register with the Site, use any of our Services, or at other times. We may receive Personal Identifiers, including your name, e-mail, and social network ID from social media websites and services if you choose to enable features such as logging in with your social media or third-party account information, for example, login with Facebook, Google, or LinkedIn features.

To enhance our Services and your user experience, we may collect detailed information regarding your purchasing behavior, such as purchase history and customer profiling, as well as technical information including Internet Protocol (“IP”) address, browser type, browsing history, device type, and interactions with our websites. This information allows us to tailor our offerings and understand how our Services are used, aiding in our ongoing improvement efforts.

The collection of information such as IP addresses, browser type, and device type, are done so automatically when someone navigates to a website, the action of going to a specific domain name customarily involves the transmission of information in what is referred to as an HTTP header. These headers typically contain a set of information, which often include an IP address from which the request originates, the type of browser used, the classification of the device initiating the request, among other data elements. This information is sent as part of a request to the server where the website you are visiting is located.

Upon receipt of the request by a website’s server, the server records various details of the transaction (i.e. the information sent above) in “logs” on the server. 
When visiting our Sites or using our Services, we use logs to analyze traffic to our websites, monitor for security breaches, optimize our website performance, and improve our Sites and Service offerings for a better experience for our customers.

Third Party Websites 
Our Site and Services may link to websites and services owned or operated by other companies, including those of our affiliates or partners.  These other websites and services are operated by other companies, and their privacy practices are governed by their privacy policies, and this Trumark Privacy Policy would not apply.  
For example, our Sites may link to a website operated by a lenders that may collect certain financial information from you to provide you with certain products or services like mortgage quotes.  

Cookies and Anonymous Identifiers
We may use cookies (a small text file placed on your computer to identify your computer and browser) and anonymous identifiers (a random string of characters that is used for the same purposes as a cookie) to analyze the use of and improve the Site and Services, and as further described in the “Advertising and Online Tracking” section of this Privacy Policy. Most browsers are initially set up to accept cookies. You can reset your web browser to refuse all cookies or to indicate when a cookie is being sent; however, certain features of the Site or Services may not work if you delete or disable cookies. Meta Pixel and Google Ads

Emails, Phone, Text Messages, Website, and Mobile Application Submissions
We may communicate information regarding our homes and other products and services through email, phone calls, text messages and mobile applications from time to time.  We collect information that is disclosed by you when you interact with us through such communication methods.

3.     HOW WE USE INFORMATION AND WHEN WE MAY SHARE AND DISCLOSE INFORMATION GENERALLY
We may use your Personal Information for internal purposes, such as to provide you with the Site and Services, to improve the Site and Services, to notify you of new products or services, and to otherwise communicate with you about our company to personalize your experience by tailoring recommendations and offers to your interests. We may also use your Personal Information to provide more relevant search results from the search functions of the Site and  Services. Except as otherwise explained in this Privacy Policy, we will not disclose your Personal Information to third parties, other than our Service Providers (defined in Section 4), without your consent. However, we may disclose to third parties, certain aggregated and/or anonymized usage data regarding the Site and Services.

We may also share Personal Information with: our affiliates such as other companies that are under common control as ours; other companies that we work with in connection with the Site and Services such as providers of promotional social media campaigns; operators of mobile applications; certain other service providers with whom we have a relationship to provide business operations services; providers of advertising, direct marketing, and lead generation, affiliate marketing programs, retargeting platforms, data brokers, ad networks, marketing consultants, and similar services providers; certain advisors such as lawyers, accountants, consultants, security professionals, and other similar parties when disclosure is reasonably necessary to comply with our legal and contractual obligations, prevent fraud or abuse, defend against attacks, and as may be required for compliance with applicable laws; parties to whom we are required by law to provide information, such as pursuant to a subpoena or a court order; parties involved in business transactions that we are involved in, such as the sale, merger, consolidation, acquisition, change in control, transfer of assets, investments, bankruptcy, or reorganization; and any party that you authorize the sharing of such information.

We may also share your Personal Information with your prior consent.

4.     SERVICE PROVIDERS
From time to time, we may establish relationships with other businesses (“Service Providers”) to provide certain services to us or to you. For example, we may contract with Service Providers to provide as hosting and maintenance, data storage and management, and marketing and promotions. We provide our Service Providers with the information necessary for them to perform these services on our behalf. We may also sometimes share your information with certain Service Providers with your consent.  
We partner with various third party software providers to store data, manage business processes and activities, enhance our services, optimize operations, and improve user experience. These Service Providers assist us with services such as customer relationship management, data analytics, project management, and communication. Such providers may include but are not limited to: Constellation HomeBuilder Systems, Lasso ECI, Homefiniti, BuildPro, CallRail, DocuSign, Dwelling Live, Eliant Surveys, Loom, and Microsoft. We only share personal information with these Service Providers to the extent necessary for them to perform their functions and require that they protect this information in line with industry-standard data protection and security practices.

5.     ADVERTISING AND ONLINE TRACKING
We may collect certain information about you when you visit the Site or use the Services. We also may allow other companies to serve our ads to you after you visit the Site or use the Services, and these third parties may collect information about your online activities over time and across different websites or online services. These companies may use non-personally identifiable information (e.g. click stream information, browser type, time and date, subject of advertisements clicked or scrolled over) in order to provide ads about our goods and services likely to be of interest to you. These companies typically use cookies to collect this information. 6.     COMPLIANCE WITH LAWS AND LAW ENFORCEMENT
We cooperate with government and law enforcement officials and private parties to enforce and comply with applicable laws and regulations. We may disclose Personal Information and any other information about you to government or law enforcement officials or private parties if, in our discretion, we believe it is necessary or appropriate in order to respond to legal requests (including court orders and subpoenas), to protect the safety, property, or rights of our company or of any third party, to prevent or stop any illegal, unethical, or legally actionable activity, or to comply with the law.

7.     BE CAREFUL WHEN YOU SHARE INFORMATION WITH OTHERS

In addition, please remember that when you share information in any other communications with third parties, that information may be passed along or made public by others. Our Site and Services may contain links to other websites or allow others to send you such links. A link to a third party’s website does not mean that we endorse it or that we are affiliated with it. We do not exercise control over third-party websites. You access such third-party websites or content at your own risk. You should always read the privacy policy of a third-party website before providing any information to the website.

11.  DATA RETENTION
We will retain your Personal Information only for so long as necessary to fulfill the purposes for which we collected it, including for satisfying any legal, accounting, or reporting requirements. To determine the appropriate retention period for personal information, we consider the amount, nature, and sensitivity of the personal information; the potential risk of harm from unauthorized use or disclosure of your personal information; the purposes for which we process your Personal Information and whether we can achieve those purposes through other means; and the applicable legal requirements. 
You may request that we delete your information by sending an email to privacy@trumarkhomes.com.  We have protocols to handle these deletions and will process them promptly.  
We may also anonymize or aggregate your information (so that it can no longer be associated with you) for research or statistical purposes.  As this information can no longer be associated with you, we may continue to use this information as we need appropriate.

12.  YOUR CALIFORNIA AND COLORADO PRIVACY RIGHTS
California and Colorado residents who provide certain types of Personal Information in obtaining products or services for personal, family or household use are entitled to request and obtain from us once a calendar year (for California residents) or twice a calendar year (for Colorado residents) information about certain types of Personal Information we shared, if any, with other businesses for their own direct marketing uses.

-to opt out of the processing of the Personal Information for purposes of (i) targeted advertising, (ii) the sale of personal data, or (iii) profiling in furtherance of decisions that produce legal or significant effects concerning you.

13.  CHILDREN’S PRIVACY
The Site and Services are intended for users who are 16 years old or older. We do not knowingly collect Personal Information from children under the age of 16. If we become aware that we have inadvertently received Personal Information from a child under the age of 16, we will delete such information from our records. California users under the age of 16 may request the removal of their content or information publicly posted on the Site or Services by emailing privacy@trumarkhomes.com. 

14.  PROCESSING IN THE UNITED STATES
Please be aware that your Personal Information and communications may be transferred to and maintained on servers or databases located outside your state, province, or country. 

If you are located outside of the United States, please be advised that we process and store all information in the United States. The laws in the United States may be different than those in your location. By using the Site or Services, you are agreeing to the collection, use, transfer, and disclosure of your Personal Information and communications will be governed by the applicable laws in the United States.
