At Trumark Homes, we highly value our partnerships with our Broker community. Our Broker program is designed to recognize and reward your efforts for introducing prospective buyers to our communities. To ensure a smooth and transparent process, we have established the following guidelines for Broker participation and compensation eligibility.
 
Trumark Homes reserves the right to modify or terminate this Broker policy at any time without prior notice. For further details, please contact a New Home Sales Representative.
Conditions for Broker Compensation Eligibility
  1. Client Registration & Accompaniment
    • Brokers/Agents must physically accompany and personally register their client (a “Prospect”) on the Prospect’s first visit to a Trumark Homes community.
    • If the Prospect has previously visited a community without their Broker/Agent, no compensation will be paid.
    • Registrations are only effective for a single Trumark Homes community.
  2. Broker Registration Form
    • Brokers/Agents must complete and sign the Broker Registration Form, which is available at the sales office of each participating Trumark Homes community.
    • The Broker Compensation Agreement will be executed at the time the Prospect enters into a Purchase Agreement (after this point, the Prospect is referred to as a “Buyer”).
  3. Buyer Representation and Broker Compensation Agreement Requirement
    • To be eligible for compensation, the Broker is required to provide a copy of a Buyer Representation and Broker Compensation agreement  (“BRBC”) with the Buyer to Trumark Homes prior to execution of the Purchase Agreement.
  4. Registration Period
    • The Broker registration is valid for 90 days from the date of the initial registration. If the Prospect does not execute a Purchase Agreement prior to the expiration of the 90-day period, the registration will automatically lapse. To maintain eligibility, Brokers must personally return with their client to re-register for another 90-day period. Email, fax, or phone re-registration is not permitted unless explicitly approved in writing by Trumark Homes.
  5. Community-Specific Purchases
    • The Prospect must enter into a Purchase Agreement within the registered community. If the Buyer purchases in a different Trumark Homes community, no compensation will be paid unless the Buyer separately registered for that community.
  6. Compensation Payment
    • The compensation amount will vary by community and division. Brokers should confirm the specific compensation amount with the New Home Sales Representative at the community where their client is purchasing.
    • Payment will be made through escrow to the licensed brokerage company identified on the Broker Registration Form.
    • Only one compensation will be paid per transaction, and Trumark Homes will not mediate disputes between competing broker claims.
  7. Conditions for Compensation  Payment
    • The Broker compensation will be paid only if all the following conditions are met:
    • The Buyer closes escrow on the home purchase.
    • The registered Broker/Agent is still employed with the registered brokerage, and their DRE license is active and in good standing at the time of closing.
    • The Buyer has not assigned their Purchase Agreement to another party.
    • The Broker/Agent executed the BRBC at the time of contract execution and provided a copy to Trumark Homes in compliance with Section 3 of this policy.
    • Any compensation or bonus offered by Trumark Homes will not exceed the aggregate sum of compensation that the Buyer has agreed to pay the Broker pursuant to the BRBC.  If the offered compensation is greater than the compensation payable pursuant to the BRBC, then the commission payable to the Broker will automatically be reduced to equal the sum payable for compensation under the BRBC.
  8. Sales Process & Representation
    • All Purchase Agreements and related documents must be prepared and executed using Trumark Homes' standard DRE-approved contracts.
  9. Policy Acknowledgment
    • By participating in Trumark Homes’ Broker program, Brokers/Agents acknowledge and agree to abide by these policies. Trumark Homes reserves the right to determine final eligibility for any compensation in its sole discretion.
